In the process of secularization in Europe I paid attention to the Enlightenment in which the ideas of John Locke and Thomas Hobbes were predominant. They advocated the concept of natural law and the theory of Commonwealth. And they also insisted that the State should be means to protect each one's natural right by regarding it as the 'second' natural law. Locke insisted that the commission of the natural right should be limited to the possession of external and social things. Therefore State had no rights to interfere in the inner spiritual matter especially religious freedom. I think these views are important and effective even now although Commonwealth State changed itself to the contemporary mass State. \n Secondly I want to focus on the Japanese history. After World Was II Japanese nation was said to make a great change and in fact adopted the policy of the separation of the Church and State. But there remains many inseparable factors between before and after the war. As one of them I picked up the matter of the first and the ninth article of the Fundamental Law of Education. \n The first article of it says that education shall aim at the full development of personality. According to Kotaro Tanaka who was the Minister of Education and who preferred to adopt \"the full development of personality\" (rather than \"the cultivation of human nature\") in which the personality presupposes the image of religious human being which seeks holiness as an ultimate purpose. This view might come from his own Catholic natural law but I think that more important reason why he used this expression that he was a supporter of the Imperial manuscript of Education which was the principle of the national education before war. \n The previous one of the ninth article of the Fundamental Law of Education which Education Reform Committee made at the 21st of Showa used the expression of \"cultivation of the religious sentiments\". This expression also came from the education inspired by the Imperial Manuscript of Education. \n In this way through the first and ninth articles of Fundamental Law of Education, it indicates the inseparation of the established religion of the pre-war age. It means that Japanese nation lacks in a fundamental viewpoint of secularization as the commonwealth State and also doesn't recognize a great task to establish the religious freedom.
